Terms and Conditions

Damonza.com is the trading name of Booknack Limited, a limited liability company registered in New Zealand. These Terms and Conditions apply to all services offered by Damonza.com. By placing an order, you agree to the following:

Book Cover Design Services

• Deposit: A 50% deposit is required to begin any cover design project.
• Deliverables: Ebook covers include a high-resolution JPEG and 3D mockup. Print covers include a high-res print-ready CMYK PDF based on your printer’s template, plus ebook and 3D files.
• Printer files: The print file includes one version for one service provider. Additional versions incur extra costs.
• Stock images: We license royalty-free stock images for use only in your book cover.
• AI usage: Commercially licensed AI-generated imagery (e.g., Midjourney) may be used as part of your design, combined with stock and professional layout elements.
• Discounts: Coupon codes apply only at the time of ordering and cannot be applied to add-ons or future orders.

Book Cover Design Process

• Concepts: You’ll receive 1, 2, or 4 draft concepts depending on the package.
• Revisions: You may request changes to one draft. Revisions are typically delivered within 2–3 business days.
• If no concept is approved, we’ll offer a new option. If still unsatisfied, the project may be cancelled and refunded.
• Reverting: Returning to a previously rejected draft requires a new fee (minimum 50% of the ebook cover price).
• Change limits: Budget/text-only packages include 3 revision rounds. Other packages allow unlimited reasonable changes. We may cancel and refund if expectations are not manageable.

Subscriptions

• Plans: Subscriptions include 3, 5, or 10 custom covers over 12 months, billed monthly.
• Usage: Covers can be requested at any point during the subscription period. Unused credits expire after 12 months.
• Cancellation: Allowed only if total payment equals or exceeds the value of completed work.
• Subscriptions are excluded from standard refund offers related to one-off services.

Reasonable Changes

• Definition: Reasonable changes include adjustments to layout, fonts, colors, positioning, and image swaps using stock — but not full redesigns or new concepts.

Approval and Licensing

• Approval: Once a design is approved, final invoices are issued. Files are delivered after full payment.
• License: You receive an exclusive license to use the final design for your book and related marketing. Earlier drafts may not be reused.
• Responsibility: By uploading final files to a printer or publishing platform (including POD), you accept full responsibility for the results. Damonza.com is not liable for post-approval issues.
• Specification changes: Changes in trim size, page count, paper type, spine width, or printer template may affect final output. We are not responsible for associated costs.
• Clients accept approved files as final, even if minor errors are later discovered.

Print Cover Design Process

• After approval: Once the front cover is approved, we begin designing the spine and back cover.
• Required info: We need the final trim size, page count, paper type, back cover text, ISBN, and your printer’s name. A template is required if not using KDP, Ingram, or Lightning Source.
• Changes to the above after layout begins may incur additional fees.
• Clients must order and review a printed proof before committing to full print runs. Damonza.com is not responsible for printer errors.

Formatting and Interior Layout Services

• Service: We format interiors for print and ebook using professional fonts, spacing, and layout.
• Files: Manuscripts must be submitted in Word or a similar editable format. Post-start changes may result in extra fees.
• A draft is provided for review. Reasonable revisions are included.
• Final files are delivered after full payment.
• Clients are responsible for uploading the final files to publishing platforms.
• Once approved, the layout is considered final. Revisions after approval will incur a separate fee.

Proofreading Services

• Scope: We proofread for grammar, spelling, punctuation, and naming/style consistency.
• Submission: Clients must submit manuscripts electronically and note any preferences at the start.
• Reasonable changes can be requested after the initial proof.
• Fees: Charged per 1,000 words. A 50% deposit is required to begin.
• Cancellation: If canceled after first draft, a 50% refund may be given. Later-stage cancellations are evaluated case by case.
• All proofed files must be deleted upon cancellation. They may not be reused.
• Damonza.com is not responsible for post-approval issues resulting from use of proofread files.

Cancellation Policy

• Damonza.com may cancel projects at any time due to unreasonable demands, excessive revisions, or communication breakdowns. A full refund may or may not be provided in these cases, depending on the circumstances.
• You may cancel for a full refund if you do not approve or move forward with any draft concept and no revisions have begun. This includes situations where we’ve provided alternate concepts and none were a good fit.
• Once you’ve selected a draft to move forward with and begin revisions (i.e. requested changes to a chosen concept), the deposit becomes non-refundable. Any unused add-on services may still be refunded.
• If two or more formatting drafts have been delivered, refund eligibility is at our discretion.
• No refunds are available after final approval of any design or formatted file.
• In the event of cancellation, all files provided by Damonza.com must be deleted. Clients retain no rights to any drafts, concepts, or designs.

Correspondence

• All communication must take place via email or through the Damonza.com platform. No exceptions.

Confidentiality

• All client materials and communication are confidential and will not be shared without written consent.

Limitation of Liability

• Damonza.com is not liable for any direct, indirect, or consequential damages.
• Maximum liability is limited to the amount paid for the specific service.

Indemnification

• Clients agree to indemnify and hold harmless Damonza.com from all claims, damages, or losses arising from use of our services.

Intellectual Property

• Upon full payment, clients are licensed to use the final design for their book and marketing.
• Drafts or previews may not be reused or published. No file may be used before full payment is received.

Governing Law and Jurisdiction

• These Terms are governed by New Zealand law. Disputes shall be resolved in New Zealand courts.

Severability

• If any part of these Terms is invalid, the remainder remains in full force and effect.

Changes to Terms and Conditions

• Damonza.com may update these Terms at any time. Continued use of our services implies acceptance of the current Terms.

Entire Agreement

• These Terms constitute the full agreement between Damonza.com and the client, superseding all prior communication.

Future Services

• Unless otherwise stated, any future services provided by Damonza.com are subject to these Terms and Conditions.
