These Terms and Conditions govern all services provided by Damonza.com, the trading name of Booknack Limited, a limited liability company registered in New Zealand. By accessing our website, placing an order, or using any of our services, you agree to be bound by these terms.
1. Services We Provide
1.1 Overview
Damonza offers professional book design services including:
- Custom book cover design (eBook, print, hardcover, audiobook)
- Interior formatting (print and eBook)
- Promotional materials (social media banners, animated covers, Amazon A+ content)
- The Everything Package (comprehensive design and marketing bundle)
- Cover design subscriptions
- Related design services
1.2 Service Specifications
Each service package has specific deliverables and revision entitlements as described on our website and in your order confirmation. Quotes and pricing are valid for 30 days unless otherwise stated.
2. Ordering and Payment
2.1 Deposit Requirements
- Standard Projects: 50% deposit required to begin work
- The Everything Package: Choose either:
- 50% upfront, 25% after cover approval, 25% on completion, OR
- 8 equal weekly installments
- Subscriptions: First monthly payment due upon signup
2.2 Payment Processing
All payments are processed securely via Stripe in USD. We accept major credit and debit cards.
2.3 Final Delivery
Final high-resolution files are delivered only after full payment has been received. Draft files and proofs are provided for review during the project, but print-ready and final files require complete payment.
2.4 Rush Services
Rush service is available for an additional fee, reducing initial delivery time from 10 business days to approximately 7 business days. Contact us for rush pricing based on your specific project.
3. Design Concepts and Revisions
3.1 Initial Concepts by Package
- Premium Cover Package: 4 initial cover concepts
- Standard Cover Package: 2 initial cover concepts
- The Everything Package: 3 initial cover concepts
- Budget Cover Package: 1 initial cover concept
- Text-Only Package: 1 initial typography design
3.2 Revision Allowances
Unlimited Revisions:
- Standard Cover Package (to chosen concept)
- Premium Cover Package (to chosen concept)
- The Everything Package (to chosen cover design)
- Interior formatting (layout adjustments)
Limited Revisions:
- Budget Cover Package: up to 3 revision rounds
- Text-Only Package: up to 3 revision rounds
3.3 What "Unlimited Revisions" Means
Unlimited revisions apply to refining and perfecting your chosen concept. This includes adjustments to colors, fonts, imagery, layout, and design elements. It does not mean starting completely over with entirely new concepts repeatedly. We'll work with you until you're 100% satisfied with your selected design direction.
3.4 Interior Formatting Changes
Layout Revisions: Included at no charge (styling, spacing, design elements)
Content Changes: If you need to change the actual text after formatting has begun:
- First ~10 words: No charge (grace allowance)
- Additional changes: $1 per change, minimum $15 per revision batch
- Major structural changes: Custom quote
We strongly recommend finalizing all manuscript edits and proofreading before formatting begins.
4. Deliverables
4.1 Cover Design Deliverables
- High-resolution JPEG for eBook (typically 3000px, meeting all retailer requirements)
- Print-ready PDF with spine and back cover (if print format ordered)
- 3D marketing mockup
- Layered source file (PSD) upon request
- ISBN barcode generation and placement (for print covers)
4.2 Interior Formatting Deliverables
- Print-ready PDF in your specified trim size
- EPUB file for eBook distribution
- KPF file (Kindle Package Format)
- All files tested and validated for major platforms
4.3 The Everything Package Deliverables
Everything listed above, plus:
- 8 custom social media banners (sized for Instagram, Facebook, Twitter/X, and more)
- Cover reveal graphics
- Animated book cover (MP4 format)
- Amazon A+ content modules
- Tagline development
- Blurb refinement assistance
- Banner copywriting
4.4 File Formats
All assets delivered in appropriate professional formats: JPG, PNG, PDF, MP4, EPUB, or KPF as applicable to each deliverable.
5. Rights and Licensing
5.1 Your Rights
Upon full payment, you receive an exclusive, perpetual license to use all final approved designs for your book and its promotion, including:
- Book covers on all retail platforms
- Marketing and promotional materials
- Website and social media
- Press releases and media kits
- Book trailers and advertisements
5.2 Limitations
The license does NOT automatically include:
- Merchandise production (t-shirts, mugs, posters, etc.) beyond minimal promotional use
- Derivative works unrelated to the book
- Sublicensing to third parties
- Use of rejected concepts or drafts
If you need extended rights for merchandise or other uses, contact us to arrange appropriate licensing.
5.3 Stock Assets and Fonts
All stock images and fonts are licensed under the terms of their original suppliers (Shutterstock, Adobe Stock, etc.). These licenses cover standard book and promotional use but may have limitations for other applications.
5.4 Before Full Payment
No design files, drafts, or concepts may be used, published, or distributed before full payment is received.
6. Artificial Intelligence (AI) Policy
6.1 Our Approach to AI
Damonza selectively uses generative AI as a design tool under strict guidelines:
- Never to generate entire covers or handle typography
- Never to mimic other artists' styles or use real people's likenesses
- Only to create specific design elements that enhance the overall composition
- Always combined with extensive human design work
6.2 Your Choice
You can opt out of any AI usage on your project. Simply indicate "AI-free preferred" in your order form or contact us. We'll use exclusively traditional design methods (stock photography, illustration, manual design).
6.3 AI Licensing and Quality
Any AI-generated elements used are:
- Commercially licensed for your use
- Quality-controlled by our design team
- Integrated professionally into custom designs
- Subject to your approval before final delivery
6.4 Transparency
If AI is used on your project, we'll inform you during the design process and ensure you're comfortable with the approach.
7. Refunds and Cancellations
7.1 Deposit-Back Guarantee (Standard Projects)
You may request a full refund of your deposit if:
- You're not satisfied with any of the initial design concepts, AND
- You have not approved a concept to move forward with revisions, AND
- No significant revision work has begun
7.2 When Deposits Become Non-Refundable
Once you:
- Select a concept and request revisions, OR
- Approve designs to move forward, OR
- Receive and approve final files
The deposit and any payments made become non-refundable, as substantial work has been completed.
7.3 The Everything Package Refund Guarantee
If we cannot deliver initial cover drafts that are satisfactory or "close to right," we'll provide a full refund of your deposit. This applies only before revision work begins on an approved concept.
7.4 Subscriptions
Subscriptions are excluded from refund guarantees. Cancellation is permitted only if the value of work delivered is less than the total amount paid to date. Once you use subscription credits equal to or exceeding your payments, the subscription cannot be cancelled without fulfilling the remaining payment obligation.
7.5 Refund Conditions
If a refund is granted:
- All provided files, drafts, concepts, and designs must be permanently deleted
- You may not use, reproduce, or reference any of the design work
- All materials must be returned or destroyed
- You agree not to repurpose any ideas or elements from the project
7.6 After Final Delivery
Refunds are not available after final files have been delivered and approved by you.
8. Subscriptions
8.1 How Subscriptions Work
Cover design subscriptions provide 3, 5, or 10 custom cover designs over 12 months with monthly billing:
- 3 Covers: ~$195/month for 12 months
- 5 Covers: ~$325/month for 12 months
- 10 Covers: ~$580/month for 12 months
8.2 Subscription Benefits
Each subscription cover includes:
- At least 2 initial cover concepts
- Unlimited revisions to chosen design
- eBook and print formats (up to 2 print formats)
- All stock images included
- Layered source files (PSD)
- 3D mockup
- ISBN barcode generation
8.3 Using Your Credits
- Redeem cover credits anytime within the 12-month period
- No waiting periods between covers
- No advance scheduling required
- Simply submit an order using your subscription code
8.4 Expiration and Cancellation
- Unused credits expire after 12 months from subscription start date
- Cancellation before 12 months is only permitted if delivered work value is less than amount paid
- Monthly payments are required for the full 12-month term
- No extensions beyond 12 months for unused credits
9. Post-Approval Support
9.1 The Everything Package
Includes 3 months of free post-approval changes for minor edits to covers and promotional materials. This does NOT include interior reformatting or major design overhauls.
9.2 Other Packages
Post-approval changes may be requested for an additional fee, quoted based on the scope of work required.
9.3 Error Corrections
If we made an error (typo in text we added, technical issue with files, etc.), we'll correct it at no charge regardless of when discovered.
9.4 Client Changes
Changes to approved content (updating a subtitle, revising blurb text, changing an author photo, etc.) may incur fees if requested after project completion, unless covered by post-approval support.
10. Approvals and Responsibility
10.1 Your Review Responsibility
You are responsible for carefully reviewing all proofs, drafts, and final files before approval and before use. You must check:
- Spelling of all text (title, subtitle, author name, back cover copy, etc.)
- Accuracy of all content
- Technical specifications (trim size, page count, etc.)
- Quality of all design elements
- Proper formatting and layout
- That all final files open correctly and display as intended
10.2 Final Approval
Once you provide written approval of final files, you accept them as complete and correct.
10.3 Use of Files Constitutes Final Acceptance
By uploading final files to any platform (Amazon KDP, IngramSpark, print-on-demand services, etc.), sending them to a printer, or otherwise using them for publication or distribution, you confirm that:
- You have thoroughly reviewed the files
- You accept the files as accurate and complete
- Any errors in the files—including those potentially introduced by Damonza—are now your responsibility
10.4 Post-Approval and Post-Use Errors
Errors not identified before approval and use—including those introduced by Damonza—become the client's responsibility once final files are approved and delivered. This applies whether the error is discovered before or after publication.
We will make reasonable efforts to assist with corrections discovered after approval, but this may involve additional charges depending on the nature, timing, and extent of the changes required.
10.5 No Liability for Costs After File Use
Once you have used the final files (by uploading, printing, publishing, or distributing), Damonza cannot be held liable for any costs incurred due to errors in those files, including but not limited to:
- Costs of reprinting books
- Costs of correcting or replacing published materials
- Retailer upload fees or corrections
- Lost sales or opportunities
- Costs of redistributing corrected files
- Any other consequential costs related to errors discovered after use
10.6 Your Final Check Is Critical
We strongly recommend that before using any final files, you:
- Open and carefully review every page of print PDFs
- Test eBook files on actual devices (Kindle, iPad, etc.)
- Verify all text is correct and nothing has been accidentally altered
- Confirm all technical specifications match your requirements
- Check that cover spine calculations are correct if page count was provided by you
This final verification is your responsibility and protects you from costly errors after publication.
10.7 Why This Matters
Once a book is published with approved files, corrections may require reprinting, redistributing files to retailers, or other costly actions. By thoroughly checking files before approval AND before use, you protect yourself from these situations. The act of using the files for publication is your final confirmation that they are correct.
11. Communication
11.1 Official Communications
All project communications, approvals, and change requests must be made via:
- Email to your project manager
- The Damonza client portal (if applicable)
- Written correspondence
11.2 Verbal Discussions
While we love to talk through ideas on consultation calls, verbal discussions are for brainstorming and guidance only. All decisions and approvals must be confirmed in writing to be official.
11.3 Confidentiality
All materials you provide (manuscripts, personal information, unpublished content, project details) are kept strictly confidential. We will not share, publish, or disclose any client materials without explicit written consent.
11.4 Response Times
We typically respond to emails within one business day (often same-day). Due to our New Zealand location, you may receive communications outside standard business hours in your timezone, but we maintain consistent communication throughout all projects.
12. Timeline and Delivery
12.1 Approximate Timelines
The following are approximate timelines. Actual delivery may vary based on project complexity, revision requirements, and current workload:
- Cover first drafts: Approximately 10 business days (approximately 7 days for Premium/Rush)
- Interior formatting first draft: Approximately 14 days
- The Everything Package: Approximately 10 business days for cover concepts; 3-5 weeks total for all deliverables
- Revision turnaround: Typically 2-3 business days per revision round
These timelines are estimates only and do not constitute a guarantee of delivery by any specific date.
12.2 Timeline Dependencies
Overall project duration depends on:
- Your feedback speed and availability
- Number of revision rounds needed
- Complexity of the project
- Whether services are combined (cover + formatting)
- Holidays and closure periods
12.3 Holiday Closures
We typically close for approximately 3 weeks over the Christmas and New Year period. Projects ordered during this closure will commence after we reopen. We will announce exact closure dates on our website in advance.
12.4 Delays
While we strive to meet all timelines, we cannot guarantee exact delivery dates due to factors that may arise. We'll communicate promptly if any delays occur and work to minimize impact on your publishing schedule.
13. Text-Only Package Requirements
13.1 Image Requirements
For Text-Only packages (where you provide the cover image):
- You must own full rights to use the image commercially
- Image must be high-resolution (minimum 300 DPI for print, 1600px+ for eBook)
- Image must be suitable for cover use without extensive editing
13.2 Additional Fees
If your provided image requires significant editing, color correction, or is not suitable quality, we may:
- Recommend a different package, or
- Quote additional fees for image preparation
14. Limitation of Liability
14.1 Maximum Liability
Damonza's total liability for any claim related to our services is limited to the total amount you paid for the specific service in question.
14.2 Indirect Damages
We are not liable for indirect, consequential, special, or incidental damages, including but not limited to:
- Lost profits or sales
- Lost opportunities or missed deadlines
- Costs of reprinting or redistribution
- Business interruption
- Reputational impact
- Costs incurred after publication or use of files
14.3 No Liability After File Use
As detailed in Section 10, once you use final files (by uploading to publishing platforms, sending to printers, or otherwise publishing or distributing), you have accepted those files as correct and complete. Damonza has no liability for:
- Errors discovered after files have been used for publication
- Any costs associated with correcting or replacing published materials
- Any losses or expenses resulting from errors in files that were used after delivery
This applies regardless of whether any error was introduced by Damonza, as you have the responsibility to thoroughly review files before use (see Section 10).
14.4 File Usage
We provide design files that meet industry standards and technical specifications for major platforms. However, we cannot guarantee that:
- Your book will be accepted by any specific platform or printer
- Files will work with all possible publishing services (we optimize for major platforms)
- Your book will achieve any particular level of sales or success
14.5 Your Responsibility
You are responsible for:
- Thoroughly reviewing all final files before approval AND before use (as detailed in Section 10)
- Testing files before uploading to platforms or sending to printers
- Verifying that files open correctly and display as intended
- Meeting any retailer or printer requirements beyond our deliverables
- Testing files on your chosen platforms before large print runs or publication
- Backing up all files we deliver
- Any use of files outside the scope of our services
- Any consequences resulting from using files without thorough final review
15. Website Use
15.1 Acceptable Use
By accessing Damonza.com, you agree not to:
- Attempt unauthorized access to any part of the site
- Interfere with or disrupt the website or servers
- Use the site for any illegal purpose
- Collect user data without permission
- Transmit viruses or malicious code
15.2 Intellectual Property
All content on our website (text, graphics, logos, portfolio images, downloadable materials, design examples) is the property of Damonza and protected by copyright. You may not reproduce, distribute, or repurpose this content without written permission.
15.3 Your Portfolio Use
Once your project is complete, we may request permission to display your cover in our portfolio. You may grant or deny this request. If granted, you may later ask us to remove it at any time.
16. Legal Matters
16.1 Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
16.2 Jurisdiction
By using our services, you consent to the jurisdiction of New Zealand courts for any legal matters arising from these terms or our services.
16.3 Severability
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will remain in full effect.
17. Changes to Terms
17.1 Updates
Damonza reserves the right to update these Terms and Conditions at any time. When we make changes, we'll update the "Last Updated" date at the top of this document.
17.2 Continued Use
Your continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
17.3 Current Orders
Orders placed before a terms update will generally be governed by the terms in effect at the time of order, unless both parties agree otherwise.
18. Entire Agreement
These Terms and Conditions, together with your order confirmation and any written correspondence regarding your specific project, constitute the entire agreement between you and Damonza. This agreement supersedes any prior discussions, proposals, or verbal agreements.
Any promises, modifications, or additional terms not included in writing are not part of our agreement.
