Damonza.com Affiliate Program Terms and Conditions
1. Introduction
These terms and conditions govern your participation in the Damonza.com Affiliate Program. By joining the program, you agree to comply with these terms and conditions.
2. Affiliate Agreement
As an affiliate, you will be appointed as a non-exclusive independent contractor to market and promote Damonza.com’s services. Nothing in these terms and conditions shall be construed as creating an employer-employee relationship. Affiliates must be recognised within the publishing industry and serious about promoting Damonza.com’s services. Generic coupon websites will not be accepted into the program.
3. Commission
Damonza.com will pay affiliates a commission starting at 5% on all referred orders that are paid in full. The exact percentage will be specified in your affiliate account. Commission payments will be made every few months, provided the referred projects are complete and have been paid in full. All payments to affiliates will be processed through PayPal.
4. Referred Customers
Customers referred by an affiliate are considered valid if they place an order within 30 days of the referral. The Affiliate Program is managed by AffiliateWP software, which tracks referrals, orders, and commissions.
5. Affiliate Obligations
As an affiliate, you agree to conduct all promotional and marketing activities in an ethical, professional, and lawful manner. You also agree not to make any false or misleading claims about Damonza.com’s services.
6. Intellectual Property
You are granted a limited, non-exclusive, non-transferable right to use the Damonza.com trademarks, logos, and promotional materials for the purpose of promoting the services. Any other use of Damonza.com’s intellectual property is strictly prohibited.
7. Termination
Damonza.com reserves the right to remove affiliates at any time, for any reason, including but not limited to, breach of these terms and conditions, or inactivity. Upon termination, all rights and licenses granted to the affiliate under these terms and conditions will cease immediately.
8. Limitation of Liability
Damonza.com, its employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your participation in the Affiliate Program or for the cost of procurement of substitute services.
9. Indemnification
The affiliate agrees to indemnify, defend, and hold harmless Damonza.com, its employees, contractors, and affiliates from any and all claims, damages, losses, or expenses, including reasonable attorney’s fees, arising from or related to their participation in the Affiliate Program.
10. Confidentiality
All confidential information, including customer information, is strictly confidential and may not be disclosed by the affiliate to any third party.
11. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the country where Damonza.com is registered. Any disputes arising from or related to these terms and conditions or our Affiliate Program shall be subject to the exclusive jurisdiction of the courts of the country where Damonza.com is registered.
12. Severability
If any provision of these terms and conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
13. Changes to Terms and Conditions
Damonza.com reserves the right to modify these terms and conditions at any time. Affiliates are responsible for reviewing the terms and conditions periodically to ensure they are aware of any changes. By continuing to participate in the Affiliate Program after any changes to the terms and conditions have been posted, affiliates are deemed to have accepted those changes.
14. Entire Agreement
These terms and conditions, together with any additional agreements or documents incorporated by reference, constitute the entire agreement between Damonza.com and the affiliate with respect to the Affiliate Program and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.
